These terms apply to your use of pacificdesignlandscape.com, operated by Pacific Design Landscaping. By using this website or submitting an enquiry through it, you agree to them. If you do not agree, please do not use the site.
These terms cover the website. The work itself is governed by the written contract you sign before any construction begins. Where the two differ, your signed contract governs.
Who we are and where we work
Pacific Design Landscaping is a landscape design-build company operating in California, serving homeowners on the San Francisco Peninsula and in the South Bay. We do not take work outside California. This website is intended for United States residents only.
Using this website
You agree to use the site lawfully, and not to:
- Submit false information, or someone else’s contact details without their permission
- Attempt to gain unauthorised access to any part of the site or its systems
- Use automated tools to scrape, copy, or overload the site
- Interfere with the site’s operation or security
Enquiries, consultations, and designs
Submitting the quiz is a request for a consultation. It is not a contract, and it does not obligate either of us to anything. We may decline an enquiry — for example, if the property is outside our service area or the project is outside our scope — and we will tell you if so.
The initial design consultation is free. Producing a photorealistic render of your property is separate paid design work, and the terms for it, including any deposit, are set out in writing before that work begins. Any figures, ranges, or timelines discussed before you have a written proposal are estimates for discussion, not offers or quotes.
Designs, renders, drawings, and proposals we produce remain our intellectual property unless your written agreement says otherwise. You may use them to evaluate and carry out your own project with us. You may not pass them to another contractor to build from, or reproduce them commercially, without our written permission.
Contacting you
When you submit an enquiry you agree that we may contact you at the phone number and email address you provided, including by automated calls and text messages, about your design and scheduling. Consent is not a condition of purchasing anything. Message and data rates may apply. You can opt out of texts by replying STOP and can ask us to stop calling at any time. How we handle your information is set out in our Privacy Policy.
Content on this site
Everything on this site — text, photographs, renders, designs, and the Pacific Design Landscaping name and marks — belongs to us or is used with permission, and is protected by copyright and trademark law. You may view and share it for personal, non-commercial purposes. You may not republish, resell, or use it commercially without our written permission.
Project photographs show work we have completed. Every property is different, and the photographs are examples rather than a promise of any particular result on your property.
Reviews and ratings shown on the site are from third-party platforms and reflect our rating at the time of publication. Current ratings are available on those platforms.
Third-party links and services
This site links to third-party services, including our scheduling provider and our review pages. We do not control those services and are not responsible for their content, availability, or their handling of your information. Their own terms and privacy policies apply when you use them.
No warranty on the website
We provide this website “as is.” We work to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free, or that all information on it is current at every moment. Nothing on this website is professional design, engineering, or construction advice for your specific property. Advice for your property comes from a consultation and a written proposal.
Any warranty relating to construction work is set out in your signed construction contract, not here.
Limitation of liability
To the fullest extent permitted by California law, Pacific Design Landscaping is not liable for indirect, incidental, or consequential damages arising from your use of this website. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here limits or alters the obligations in a signed construction contract between us.
Changes
We may update these terms. The date at the top of this page shows when they were last revised, and continued use of the site after a change means you accept the revised terms.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute relating to this website will be brought in the state or federal courts located in California.
